Areas of Practice

consumer & competition law

For the promotion and protection of the interests and rights of consumers, quasi-judicial bodies have been set up at district, state, and central levels. These bodies follow the principles of natural justice and have the power to provide relief (specific to each case) and impose penalties on those who do not comply with the orders given to them. Under the consumer & competition law, these quasi-judicial bodies work with the objective of providing swift and simple redressal to various consumer disputes. The law is crucial for safeguarding the consumers at large from getting exploited by the manufacturers, service, and product providers. For such cases, consumer lawyers are appointed.

In accordance with Consumer Protection Rules 1986, complaints for pecuniary jurisdiction can be filed with the following forums/commissions:

  • District Consumer Dispute Redressal Forum
  • State Consumer Dispute Redressal Commission
  • National Consumer Dispute Redressal Commission, New Delhi

Completion Law | Competition Act, 2002

Occasionally, large-scale businesses use their size and financial strength to keep their competitors at bay, thereby creating an instability in wealth distribution. Being a developing country, India promotes industrial growth and gives priority to its socio-economic goals. To address this, the Indian government introduced the Monopolies and Restrictive Trade Practices Act, 1969 (MRTP). The act was a way to prevent unfair practices that cause damage to the common good. Later, MRTP was replaced by the Competition Act, 2002. This newer law emphasized on:

  • Agreement among enterprises
  • Abuse of dominance
  • Mergers or, more generally, combinations among enterprises.

With this, the new act promoted fair competition and addressed the necessary socio-economic objectives.

The Competition Commission of India (CCI)

CCI was enacted on 23rd October 2003 to eliminate those practices that have adverse effects on the competition so that consumer rights and freedom of trade are protected. It also shares its opinions on competition issues that are received from a statutory authority that has been created under the law. The Competition Commission of India (CCI) also works towards public awareness related to consumer rights.
