Negotiable Instrument Act

The Negotiable Instrument Act, 1881 is an important law that governs the usage of all the negotiable instruments in India. The act covers the regulation of cheques, bills of exchange, and promissory notes. The purpose of this act was to provide a uniform legal framework to use all the negotiable instruments in India.

What Are Different Types of Negotiable Instruments?

According to section 13 of the Negotiable Instruments Act, a negotiable instrument is a promissory note, bill of exchange, or cheque that is payable either to bearer or to order. This act is crucial in all the matters that are related to economics and finance. It acts as a warning to all the people who can face any wrongs related to the monetary dealings provided it is mentioned in the Act. Knowing the provisions of the law, it is evident that the country’s laws are highly stringent when it comes to discrepancies or voluntary wrongs.

With time, the Act was amended to mitigate the financial wrongs and cases. It helps Indian citizens to do business in a simple, straightforward, and legal way so that there are fewer cases of disputes between the two parties. Also, the Act ensures that in case a dispute occurs, it can be easily solved through legislation and/or some other process.

Cheque bounce is one of the common issues these days since cheques are used for payment of fees for businesses or repayment of loans. Sometimes, such cheques with large amounts remain unpaid and hence are returned by the bank on which they are drawn. For these types of cases, Section 138 of the Negotiable Instrument Act 1881 has the provision of punishment since cheque dishonor is considered a criminal offense.
